Article 1. General

At the time of the order, the customer acknowledges having read the general conditions of sale stated and declares to accept them without reservation.

Article 2. Security

In Switzerland, the user who rides with an electric scooter must have civil liability insurance. By signing the rental contract, the tenant declares to be in possession of a private civil liability insurance and therefore to be sufficiently covered for the risks involved in traveling on the handlebars of a scooter or an electric bicycle. The liability insurance also extends to the costs of damages such as expert fees, loss of value or costs relating to rental losses. For your own safety, we recommend that you protect yourself with a helmet and protective clothing! Do not leave your machine within the reach of people under 16 without supervision, the power of the engines and the requirement of a certain balance could be dangerous for any minor. KEEP OUT OF REACH OF CHILDREN. BY SIMPLE PRESSING THE IGNITION BUTTON, THE WHEEL STARTS UP AND THE ENGINE CAN RACE VERY QUICKLY, CAUSING SERIOUS INJURY.

Some scooters are approved in Switzerland, especially if they have front and rear lights, a horn, 2 brakes, and provided they do not exceed 20km/h and the engine power does not exceed 500w.

Property damage should always be reported immediately. If persons suffer damage and/or if a third party complains of material damage or if a third party is involved as a possible (co)responsible, inform the police immediately and file an accident report. Send a copy to Ecoploration.

Article 3. Availability

The product offers on our site https://ecoploration.com are valid within the limits of available stocks. In the event of product unavailability following the validation of your order for a product displayed in stock, you will be notified by e-mail as soon as possible, your order will then be canceled or modified if you wish and you will be immediately reimbursed if your account has been debited.

Article 4. Price and Deposit

The prices and products sold are indicated in CHF and are displayed with all applicable taxes NOT included (VAT and customs duties). Ecoploration reserves the right to modify its prices at any time, but undertakes to apply the current prices which will have been indicated to you on the site at the time of your order. The products/services remain the property of Ecoploration until full receipt of the rental payment and the scheduled return according to the date and time of return. All loaned vehicles remain the property of Ecoploration. We reserve the right to charge your credit card in the event of non-insurable material damage or in the event of non-return of the vehicle. The security deposit for each rental is set at 50 CHF. The deposit is taken during payment and refunded by bank transaction after return of the scooter. Ecoploration reserves the right not to refund the deposit in the event of material damage or delay or absence of return of the scooter. The costs relating to small damages or loss of material will be charged to the customer on the basis of the official price list. Any loss will be charged to Renter at the value of a replacement item.

Article 5. Order

Orders are made 7 days a week, 24 hours a day through our online booking system on our website or by email at the following address: locations@ecoploration.com

Article 6. Approval

When validating your order, you declare that you have read and accepted without reservation these general conditions of sale of products and rentals. The validation of your order therefore implies acceptance of these general conditions of sale.

Article 7. Payment

Payment for your purchases is made via PayPal. However, it is possible for you to place an order with us by bank transfer, the bank details of which will be provided to you by email upon receipt of your order. Cash payments are only available through our official distributor partners. You cannot book a rental on the website with cash. A credit card number will be required. The security deposit is taken at the time of payment and returned by bank payment at the end of the rental.

Article 8. Right of withdrawal

You have a reflection period of 7 days from receipt of your products to exercise your right of withdrawal on our website. In this case, the shipping costs, the transaction and return costs remain your responsibility as well as a 10% cancellation fee may be charged to you, depending on the type of withdrawal. You will have to contact us by e-mail for the refund and it will be carried out as soon as possible at the latest within 5-7 working days after receipt of the request.

Article 9. Delivery / Receipt

You must pick up your rental at the location mentioned on your invoice receipt. For an additional fee, we can deliver your rental to a pre-determined location. Ecoploration will provide all items provided for in the rentals. You must provide an identity document at the time of receipt of the rental.

Article 10. Right to repair and after-sales service

A repair estimate for equipment with no hidden defects will be made when the equipment is returned, detailing the price and deadlines. If you do not accept the quote, an expert fee of CHF 90 will be charged. In all cases, the costs of returning the equipment will be invoiced with the exception of the removal of the equipment from our premises. The material will be delivered after receipt of payment.

Article 11. Confidentiality of banking data and security of transactions

PayPal is used for payment and securing personal data relating to the payment of orders. PayPal is responsible for the automated processing of this data, the purpose of which is to define the level of analysis of a transaction and to fight against bank fraud. The occurrence of an outstanding payment due to fraudulent use of a bank card will lead to registration in a payment incident file and will be subject to prosecution by third parties or by Ecoploration.

Article 12. Responsibility for use

The buyer declares to be of legal age, to take full responsibility for the use of the products purchased on the site and releases the seller (ECOPLORATION.com) from all liability (such as accidents, injuries and manufacturer’s liability) The buyer undertakes to find out about the laws in force in his country. As of June 2019, the legislation in force on the conditions of use in Switzerland is as follows for electric scooters: the law is different depending on the model used. The user is obliged to inquire with the competent services of the country/canton in which the machine is used. If the customer asked us to unleash his machine at its maximum speed, he assumes the consequences 100%. Some electric vehicles are authorized up to 20 km/h but not beyond. In the event of an accident, arrest or any other problem, the customer will be solely responsible for the dispute generated.

Article 13. Copyright and Liability

The photos are provided for information only and are not contractual. The names, texts, photos, logos and videos are the property of Ecoploration and any reproduction, even partial, is prohibited without express written consent from us.

Article 14. Jurisdiction

Ecoploration is the owner of the Ecoploration.com site in Switzerland, but also in other countries. We are an international entity and in case of dispute or litigation the court of Geneva is competent and the applicable Swiss law, but also the Canadian law under the court of Quebec.
